Terms and Conditions
In these general terms and conditions the following terms are used in the following meaning, unless explicitly stated otherwise.
Sanders Marketing: the determiner of these general conditions.
The customer: a counterpart who is a natural person.
These conditions apply to every offer, quotation and agreement between Sanders Marketing and the customer to which Sanders Marketing has declared these conditions applicable, insofar as the parties have not deviated from these conditions expressly and in writing.
2. The present conditions also apply to Sanders Marketing agreements, for the execution of which third parties must be involved.
3. Any deviations from these general terms and conditions are only valid if expressly agreed in writing.
About the products:
The articles offered are depicted and / or described as clearly and truthfully as possible on the website and / or in written offers and have the features that Sanders Marketing mentions in the offer. The website clearly indicates what the customer owes upon purchase and what his rights and obligations are, if one accepts the offer.
About the order:
Sanders Marketing only delivers after receipt of payment, unless a cash on delivery has been chosen. Regardless of the method of payment chosen by the customer when ordering, Sanders Marketing reserves the right not to execute orders or to execute orders at a later date.
About returning shipments / products:
A 7-day viewing period applies to all purchases. The visibility period means that the customer has the right to return the articles within seven days without any obligation on his part in original packaging. The returned items must not be used or damaged. The customer must also comply with all conditions for return. The costs for the return shipment are borne by the buyer. After receipt of the shipment and approval from Sanders Marketing about the state of the products, the money of the buyer will be refunded within 30 days.
Sanders Marketing does its utmost to deliver the orders as quickly as possible. If the delivery is delayed - either by temporarily not being in stock, or for other reasons - or if an order can not or only partially be executed, the customer will receive notification thereof.
If Sanders Marketing has specified a delivery period, this is indicative. A specified delivery time is therefore never a fatal deadline. However, the final delivery time will never exceed the specified delivery time by more than one week, unless there is force majeure. If a term is exceeded, the customer must provide written notice of default to Sanders Marketing.
The customer pays the shipping costs. The shipping costs are stated on the website.
Sanders Marketing carries the risk of damage and loss of the items during sending to the customer. After the items have been received by the customer, the risk of damage and loss is transferred to the customer. If one or more articles are lost, the customer undertakes to cooperate on the first request. In the event of non-compliance with this obligation, Sanders Marketing is entitled to recover the price of the items from the customer.
About the warranty:
Sanders Marketing guarantees the soundness and / or usability of the delivered items, in accordance with the specifications offered on the web shop. The date on the invoice / packing slip is the starting date for the guarantee.
Any defect in an article that arises from normal and judicious use, will be replaced free of charge by Sanders Marketing at the written request of the customer within the warranty period of one month after purchase. If the customer is rightly requesting a replacement, Sanders Marketing is also entitled to opt for a refund of the purchase price from the customer.
In so far as the manufacturer makes further exclusions in the manufacturer's warranty, these limitations are taken over by Sanders Marketing.
In case of visible defects, the customer must return the item at the expense of Sanders Marketing within the visible period, stating the defect.
In case of hidden defects, or in the case of visible defects after the visible term, every complaint must be reported within 14 days, but no later than one month after the invoice date. The customer must send in writing a description of the identified defects. If the customer does not request a repair or replacement in writing, Sanders Marketing will decide whether the article will be replaced.
For articles that the customer sends on his own initiative, the transport costs are for his account. Sanders Marketing is in that case not liable for damage caused during transport.
Sanders Marketing is not liable for damage that the customer or a third party suffers due to the use of an article delivered by Sanders Marketing, unless the customer proves that the damage was caused by intent or gross negligence of Sanders Marketing. (In) direct costs or damage to the customer or a third party, caused by the use of a defective article, are not eligible for compensation, unless the customer demonstrates that the costs or damage have arisen due to intent or gross negligence of Sanders Marketing.
About back payments:
Amounts already paid for items that are returned within the visible term or advance payments made by the customer, based on conditions set by Sanders Marketing, will be refunded if the sale is not made.
By placing an order data is stored in the personal registration of Sanders Marketing.On written request of the customer, the stored personal data will be provided for inspection. The corrections communicated by the customer will be processed in the registration, unless the corrections prove to be incorrect.
Sanders Marketing does not provide data to third parties for legitimate reasons, or outside the scope of its personal registration, as a result of which the privacy of the customer is at stake.
Sanders Marketing can not accept any liability for the consequences of misprints (typing errors) on the website or other forms of media.
By placing an order each customer declares to agree without reservation with the above sales conditions.
